The current Succession Act Cap 162 needs to be amended to do away with provisions that are discriminatory towards women, which is contrary to the constitution. The constitution court pronouncement rendered these provisions unconstitutional and thus null and void on the basis of gender discrimination. Once these provisions are reformed, they will bring the Act into conformity with the constitution.
The areas that need address include the gender insensitive sections, which discriminate between men and women, the definition of child and protection of rights of children and surviving spouses.
In this regard, Landnet Uganda embarked on a review process of the Succession Act to identify provision ns and sections that need amendment.
Landnet Uganda is a nongovernmental organization founded in 2012, as a network engaged in research, capacity development and policy advocacy on land, gender, agriculture and natural resources management.
In a roundtable meeting with the Uganda Women Parliamentarian Association (UWOPA) Executive Landnet presented the proposed Succession Amendment Bill explaining sections and clauses that need amendment in the Succession Act, Cap 162.
The amendment of the Succession Act is intended to bring it in conformity with the Constitution of the republic of Uganda and provide for gender equality in accordance with articles 21 & 33 of the Constitution.
